1. Pro Club Subscription

1.1. Pro Club is a subscription program that allows you to receive exclusive deals and benefits up on a weekly, monthly, and yearly basis to the limit stipulated by the plan you subscribe to and for Purchase made via Boighor’s APK subject to the Terms and Conditions (“Boighor T&Cs”) below. 
1.2. These terms and conditions govern your pro club subscription with Boighor.

2. Eligibility

You can sign up for the Boighor app or web if you are 18 years of age or older. In order to subscribe you need a valid credit or debit card or any active Mobile Financial Service (MFS) account or a GP number for direct billing. You may add a new card or MFS account details each time you purchase any book/s. If you are subscribing to Boighor using the Grameen phone then a singular number can have only one subscriber active at a time.

3. Subscribe to Proclub

Boighor’s Pro Club is available for all! To sign up, you just need to update your Boighor app, go to your ‘Profile’ or the panel (right down in your Boighor app) and look for ‘ Pro Club’. Check out all the awesome weekly, Monthly, and yearly Perks (as defined below) and click ‘Subscribe now’. Add your chosen payment method details and you’re in!

4. Pricing

4.1. Trial Period - There will be no trial period for the user. 

4.2. Paid Subscription - The cost of the paid subscription will be clearly stated during the sign-up process and in the App. You will be informed of the subscription fee and any applicable taxes before you confirm your subscription.

5. Subscription Function

5.1. As the Boighor subscription model is established as a recurring model, You will be notified of the subscription fee every time of deduction for available plan/s that you have chosen. You can cancel the subscription plan you have chosen and upgrade your plan anytime by paying the designated amount with VAT. 

5.2. Payment of the subscription fee will be made upfront, together with payment by credit card or debit card registered under your name; or (c) any MFS linked to your account or (d) other form of payment method accepted by BOighor from time to time.   

5.3. You warrant that you are duly authorized to pay the subscription fee using the selected payment method, without infringement of any third-party rights. 

5.4. You understand and agree that Boighor is not liable in any way for erroneous purchasing statements or incorrect charges, and that in the event of a billing error that is caused by Boighor service, our only responsibility is to correct such billing error or incorrect charges within a reasonable time of us receiving notice of the error. 

5.5. Once the subscription fee has been successfully paid to Boighor, it is refundable in case of technical problems and asked for a refund within a period of 7 days after payment is done.

5.6. Your Boighor subscription period is based on the plan period selected and will continue until the expiry of such period unless it is canceled or terminated in accordance with any kind of violation of Boighor’s privacy policy. During the specified billing cycle, your Boighor subscription plan will be automatically renewed into the then-current subscription plan. You must cancel your plan before the expiration of the specified billing cycle if you do not wish to be charged the then-current Subscription Fee.

5.7. You will gain access to your Boighor subscription plan only after you have successfully paid the subscription fee and complied with all other applicable requirements to register an account on the Platform. If the process is not successfully done, your Boighor subscription plan will not come into effect.

5.8. Your Monthly Perks can only be used for orders made via the Platform in Bangladesh. All the weekly/Monthly/yearly Perks will be credited to your account on a one-time purchase basis and will expire at the end of each term. For the avoidance of doubt, the meaning of “weekly” and “week”/“monthly” and “month”/”yearly” and “year” in this clause shall be based on the date on which your Boighor subscription comes into effect. Hence, if your Boighor subscription comes into effect on 15th February 2024, your perks will be credited to your account on 15th February 2024 and will expire on 22 February 2024, for weekly, 14th March 2024 for monthly, and 14 February 2025 for yearly, and so on.

5.9. Your plan is non-transferrable and you shall not share it with other users.

5.10. The exact type of package that you will receive will be as stated at the time of subscription and may be revised from time to time. Further information about the packages may be found under the Boighor subscription page “pro club” in the Platform.

5.11. You may cancel your plan at any time by accessing the unsubscribe link in your account. If you encounter any issues, you may also reach out to our customer service through the Help Centre available on the Platform to cancel your plan.

5.12. Once you cancel your plan, you will not be able to use your benefits until the end of the subscription period.

5.13. Boighor will not make any partial or full reimbursements for subscriptions canceled prior to the expiry of the subscription period.

5.14. Boighor may at its sole and absolute discretion terminate your plan if we become aware or strongly believe that you have breached these Terms.

6. Subscription Period

Your Boighor subscription period is valid for one calendar week or one calendar month or six months or a calendar year in length (depending on the plan you select) and will automatically renew on a weekly/monthly/bi-annually/ annually basis until canceled or terminated in accordance with these terms and conditions. You can sign up at any time during the month, e.g. if you sign up on the 15th of February 2024, your perks will be credited to your account on the 15th of February,2024, and will expire on 22 February,2024, for weekly, 14th March,2024 for monthly and 14 February 2025 for yearly, and so on.

7. Subscription Fees

7.1. The Subscription Fee to be paid will be shown to you at the time of subscription. Your Subscription Fee will be charged to the credit or debit card or the MFS account or from the Grameen Phone number that you have selected at the time of signing up for Boighor and on every weekly/monthly/bi-annual/annual renewal thereto. If any Subscription Fee payment fails, your subscription will be canceled and you will need to subscribe again in order to receive benefits.

7.2. By subscribing to Pro Club, you acknowledge and agree that you are entering into an auto-renewal subscription agreement. For avoidance of any doubt, this means that Boighor will first bill you for the Subscription Fee on the date that you subscribe to your plan. Thereafter, Boighor will automatically charge the Subscription Fee using the Payment Method on the last day of the then-current billing cycle, until and unless you cancel your plan, change your Payment Method or Boighor suspends or terminates Pro Club in accordance with these terms and conditions.

7.3. Boighor reserves the right, exercisable in its sole and absolute discretion, to adjust the Subscription Fee at any time. Boighor will announce any changes to the Subscription Fee in accordance with the amendment procedure. Unless communicated otherwise, price adjustments shall take effect on the next billing cycle.

8. Pro Club  Refund

8.1.If for any reason you are unsatisfied with your subscription in Pro Club, you may request a refund as long as your purchase meets the following criteria:

a) Within 24 hours from the purchase being made if you call for a refund request.
b) Refunds will be applicable for the specific subscription model that is being purchased.
c) After the subscription is canceled no refund will be provided. 

d) If the subscription model that you have purchased from our website or app is not active but you have been charged then the Refund Policy will work. Other than that this module of refund will not work. 

e) If you fail to read or listen to the purchased e-book (s) or Audiobook(s) in “Boighor” & “Boighor” fails to fix the damage or problem, You can claim a refund. The “Boighor '' team will revert back to you within 7 working days. If you’re eligible to get a refund it will be processed to your desired payment method within the mentioned time. In the case of international (outside Bangladesh) payments, it can take up to 30 working days.

8.2. Changes to our Refund Policy

We can update, amend or make any changes to this document so that they accurately reflect our Service and Policies. Unless, otherwise, required by the specific entity, those changes will be prominently posted here. Then, if you continue to use the Service, you will be bound by the updated “Refund Policy.’ If you do not want to agree to this or any updated Refund Policy, you can delete your account and ‘Boighor’ reserves the right to delete your account if terms and policies are not followed.

9. Subscription Benefits

You will receive three types of benefits as part of your weekly/monthly/bi-annual/annual subscription plan.

Free Audio Book  -  Becoming a subscriber you will be able to access the library of audio books for free and stream it any time anywhere. This offer of a free audiobook section will remain within the subscription period you have chosen. 
Flat Discounts - Discount benefits will provide you 10% discount on a purchase of any e-book you like throughout the active subscription period. In order to know the available benefits at any time, you may check out the Boighor website, Boighor Facebook page or the app.
We reserve the right to change the subscription benefits on Boighor at any time. Any benefit changes to your Boighor subscription will be communicated to you within 3 (three) days’ notice in advance through e-mail, SMS, or any other way of communication we deem appropriate, whereby benefit changes will take effect on the next weekly/monthly/bi-annual/annual renewal, if not communicated otherwise.


10. Application of Benefits

The application of benefits shall be as follows for orders made via Boighor’s App:

Free delivery:

Free audiobook library.
A good amount of cashback option.
A flat rate discount of 10% for all e-books



Boighor discounts will be auto-applied to the library. No coupon code is required if a subscription is activated.

11. Cancellation/ Termination

11.1. You can cancel your plan at any time by accessing the unsubscribe link in your account. If you encounter any issues, you may also reach out to our customer service through the Help Centre available on the Platform to cancel your plan.

11.2. Once you cancel your plan, you won’t be able to use your benefits of subscription and Your auto-renewal subscription will automatically terminate.

11.3. Boighor will not make any partial or full reimbursements for subscriptions canceled prior to the end of your current billing cycle.

11.4. Boighor may at its sole and absolute discretion terminate your plan if we become aware or strongly believe that you have breached these Terms.

12. Fair Use Behaviour

If we become aware or strongly believe that you are in violation of the Boighor T&Cs, e.g. for cases where we believe that you are sharing your account with others in order to allow them to make use of your Boighor subscription, we may, in our sole discretion, immediately terminate your Pro Club’s subscription.

12.1. Amendment
12.2.Boighor reserves the right to change or modify these Terms (including the Weekly/Monthly/yearly, and the Subscription Fee) at any time and in its sole and absolute discretion.

12.3. If you do not accept the changes, your only option is to cancel your plan before the changes come into effect. To the fullest extent permitted by applicable laws, your continued subscription after the changes come into effect constitutes your full acceptance of, and agreement to be legally bound by these Terms, as modified, and such changes to the Monthly Perks or your Proclub’s subscription as may be communicated to you by Boighor from time to time.

13. Liability

To the extent permitted by law, Boighor, its representatives, and service providers shall not be liable to you for any loss or damage including loss of account, charges done by 3rd party, or any indirect or consequential loss whatsoever, arising out of or in connection with your Pro Club’s subscription. Your exclusive remedy with respect to your Pro Club’s subscription is to discontinue your subscription.

14. Application of Platform Terms

The Terms and Conditions relating to the use of the Platform and any other terms and conditions shall continue to apply and are incorporated by reference herein. A copy of the Platform terms and conditions and Privacy Policy may be accessed in the Boighor app or on our website.

15. Governing Law & Dispute Resolution
15.1. These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law rules.

15.2. Any dispute, claim, or difference of any kind whatsoever arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

16. General

16.1. These Terms are solely for your and our benefit and are not for the benefit of any other person or entity, except for our affiliates and subsidiaries (and each of our and their affiliates' and subsidiaries' respective successors and assigns).

16.2. These Terms supersede any previous agreement between us and constitute the entire agreement between you and us relating to its subject matter to the exclusion of all other terms and conditions, and any prior written or oral agreement between us.

16.3. Unless otherwise stated, your and our rights and remedies under these Terms are cumulative and do not exclude any other right or remedy provided under applicable laws.

16.4. Nothing in these Terms is intended to or shall be deemed to, establish any partnership or joint venture between us, nor make you or us the agent of one another for any purpose.

16.5.Boighor reserves all rights not expressly granted herein.

16.6. You may not assign, sublicense, or transfer any rights granted to you hereunder or subcontract any of your obligations.

16.7. If we do not insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you or that you do not have to comply with those obligations. If we waive any rights, we will only do so in writing, and that will not mean that we will automatically waive any right related to any later default by you.

16.8. In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
